Signature Sweets by Meli1. General & Governing LawSignature Sweets by Meli operates in Durham Region, Ontario, Canada. These Terms & Conditions are governed by and interpreted in accordance with the laws of the Province of Ontario.By placing an order, submitting payment, or accepting delivery, the customer acknowledges that they have read, understood, and agreed to all terms outlined below.2. Orders, Pricing & PaymentAll products are custom-made.Full payment is required upfront to secure production for one-time orders.Monthly Retainers require a minimum 3-month commitment, with full payment due at the beginning of each month.Orders are not confirmed until payment is received.Prices are listed in CAD. HST (13%) is applied to all invoices.Online payments are subject to a 2.8% + $0.30 processing fee.Failure to submit payment on time may result in production delays, order cancellation, or forfeiture of service without liability to Signature Sweets by Meli.3. Changes, Cancellations & RefundsOnce production has begun, changes, cancellations, or refunds are not permitted.Due to the customized and perishable nature of edible products, all sales are final.4. Artwork, Designs & Client ResponsibilityDesigns are produced using client-supplied logos, images, and brand assets.Custom graphic design, brand development, or image editing is not included unless expressly agreed to in writing.Clients are solely responsible for reviewing and approving artwork prior to production.Once approval is given, Signature Sweets by Meli is not responsible for errors including, but not limited to spelling, layout, sizing, colour interpretation, or design placement.5. Edible Printing & Colour VariationDue to the nature of edible inks, food surfaces, printing methods, and lighting conditions, colour results may vary slightly from digital files or proofs. Exact colour matching is not guaranteed.These variations are considered normal and do not constitute defects.6. QR Codes & Third-Party ContentQR codes are printed as provided or generated at the time of production and are tested prior to printing.Signature Sweets by Meli is not responsible for third-party website outages, platform changes, expired links, redirects, or external content after delivery.Ongoing QR code monitoring, hosting, or updates are not included unless specifically agreed to in writing.7. Marketing & Image UsageUnless otherwise requested in writing prior to production, the customer grants Signature Sweets by Meli permission to photograph finished products and use those images for marketing, promotional materials, social media, website content, and portfolio display.This does not include the resale or misuse of proprietary client branding beyond showcasing completed work.8. Food Allergies & Ingredients NoticeSignature Sweets by Meli operates in a shared kitchen environment that handles common allergens, including but not limited to: milk, eggs, wheat, soy, peanuts, tree nuts, sesame, and seafood.While reasonable care is taken, cross-contamination cannot be guaranteed, and Signature Sweets by Meli does not make allergen-free claims.Edible inks and food colouring are approved for consumption by manufacturers but may contain ingredients derived from common allergens (such as soy).Customers are responsible for informing guests of potential allergens.
To the fullest extent permitted by law, Signature Sweets by Meli is not liable for allergic reactions or adverse effects resulting from consumption.Ingredient information is available upon request.9. Certified Kitchen & InsuranceAll products are produced in a certified kitchen environment. Signature Sweets by Meli maintains appropriate business insurance in accordance with Ontario requirements.10. Pickup, Delivery & Risk TransferPickup and delivery details are agreed upon at the time of booking.
Signature Sweets by Meli is not responsible for delays caused by weather, traffic, venue access restrictions, or third-party delivery services.Once products are delivered or picked up, risk and responsibility transfer to the customer.11. Limitation of LiabilityTo the fullest extent permitted by law, Signature Sweets by Meli’s liability is strictly limited to the total value of the order.Signature Sweets by Meli is not liable for indirect, incidental, consequential, or reputational damages, including lost profits, event disruption, or marketing outcomes.12. Acceptance of TermsBy submitting an order or payment, the customer confirms acceptance of these Terms & Conditions and the Food Allergy & Ingredients Notice.
